Conditions of sale and information Equi-Phoenix s.l.
Equi-Phoenix s.l. does the biggest effort to make sure that the information that appears in this page is correct and is updated. 

 

I. Orders

1. All the orders will be able to be formulated by email, fax, written or by telephone.              

2. An order is not definitive until is accepted by Equi-Phoenix.                               

3. By each order we will request its data (name, telephone, address…) and later we confirmed the order by email or fax.                           

4. The confirmation of the order must be signed by the client and returned to Equi-Phoenix s.l. by mail.                      

5. All stipulation that derogate or completes the present general conditions of sale will be considered accepted by the Client if there is no written question by part of this one.

 

II. Prices

1. The information that appears in catalogues and the lists of prices is only indicative. All the prices and information are correct at the time of printing the catalogue but they can be changed  according to Equi-Phoenix s.l. we will be able to modify them at any time, without previous warning, based on the evolution of the economic conditions, without to have informed the client of  these changes.

2. Once the wished product is selected, the price of the product  is in Euros and  TAXES  NOT included, only if indicated different for a specific product. This is done because of the taxes vary according to the country from which takes place the purchase, the nature of the product and the fiscal situation of the person or company that makes the purchase. The final price does not include the expenses relative to the shipment, packing and insurance. Therefore watch the individual conditions for each product very well.   .                  

3. In relation to the Taxes (IVA), in general is applied the tax type of 18% for the dependent countries of the European Union. On certain articles the tax type will be of  7 or 4%. The person or company will only be free of Taxes within the European Union who is registered in the corresponding intra-communitarian listings.   

4. For sales outside Spain, they will be free of TAXES. The same thing happens with the purchases is made from the Canary Islands, Ceuta and Melilla. Note that the customs systems of each country will apply the corresponding taxes burden.                                                                                              

5. In the Final Summary of Purchase is the definitive price of the same one, indicating the amount corresponding to the applicable taxes. The buyer will have to inform use before the purchase that he or she is free of TAXES.

 

III. Tariffs or tax

1. Observe please that if the address of delivery given in an order that is outside the EU a tax of import can be payable on the receipt of the merchandise. The amount to pay depends on the destination and can be according to change. These payments are the responsibility of the client and we do not accept any responsibility by any payments that can have. The orders put outside Europe will be according to a load of the additional franking that is invoiced separately before the order - is sent that we will take in the consideration any franking paid in the original invoice.

 

IV. Modes of payment

1. Against reimbursement: In the Iberian Peninsula (Spain, Portugal and France), as well as in Balearic, Canary, Ceuta and Melilla, Andorra, South America, Belgium and G.H.Luxemburg to election of the client, the shipment against reimbursement of the amount of the purchase will be able to be carried out. This shipment will be made through a corresponding carrier company. This system can not previously be used outside the mentioned geographic zones.

2. Transference: Also it will be able to make the payment of your order by means of a bank transfer. If you choose this mode of payment, we will indicate an account number to you where the amount of your purchase will need to be transferred, and the order will be shipped as soon as we have confirmation of the payment.

3. With this system of payment, does not consider the purchase effective until we have confirmation of the transfer to our bank account. The client can make agile the shipment process if he or she sends by fax or electronic mail the receipt of transfer.

4. We do NOT except paymesnt by cheque!!

V. Delivery

1. Equi-Phoenix s.l .reserves themselves the right to change the shipping company.

2. The delivery time is different for each product and is an estimated time.

3.The time of delivery depends on the transport company(and weather conditions) Any delay in the time of delivery is NOT the responsability of Equi-Phoenix Sl and so is not an excepted reason for annulation of the order.

4. This takes place at the moment that Equi-Phoenix s.l. is in possession of the payment and the confirmation of the order signed by the client.                                                                                  

5. The delivery is considered carried out when the product is in possession of the Client done by the transport company and done at the address + signed the reception of the delivery. It is necessary to verify products from the reception and exposing all the reservations and claims that can be done.

6. If the products are not in agreement with the nature or amount witch is specified ones in the delivery letters patent, the Client will have to formulate his claim in writing within the seven (7) following days to the delivery.

7. The deliveries will take place with expenses in charge of the Client.

I V.  Reserve of property - Risks

1. Equi-Phoenix s.l. will keep the property of all products until the integral payment of the sale price is done specifically, interest, expenses, etc. Consequently, it will not be considered carried out the payment, according to the present disposition, of the change letters, the promissory notes, the checks or any other title that create obligation to pay until it is arrived at good  in the collection of these documents.

2. However, the risks are transferred to the Client from the delivery of products. The Client commits to the safekeeping and conservation of products and to subscribe the pertinent insurances in order to cover the damages susceptible to be caused to products.

3. In case that the Client suspends the payments, Equi-Phoenix s.l. will be able to demand all products. The amounts paid at the account previously will stay in possession of Equi-Phoenix s.l. for penalty clause.

VIII. Returned merchandise

1. Examine the merchandise please at the arrival, if they are damaged get in contact with us immediately by telephone, fax or email.                  

2. The buyer will be able to stop freely the contract within the counted term of seven days from the date of reception of the product (according to art.44 of Law 7/1996, of 15 of January of Arrangement of Retail Comercio). Verify with us before returning any merchandise.

3. To return all the material it will be able on only 1 way:

A. If the client carried out the payment against reimbursement or by bank transference, a nominative check a will be send as refund and done by post office. 

The right of dropping the claim of the buyer does not imply some penalty imposition, but he or she will have to satisfy the direct expenses of return. The returned merchandise must be in perfect and unused conditions. All the merchandise are due to return in the term of 30 days of receipt, in there original condition - as packed, original for any reason. The packed material must also be in the same condition that when it was received, in its case, to compensate the flaws of the object of the purchase.

B. For the international returns (that is to say, outside the EU), a customs declaration that it indicates that the merchandise are becoming, for the replacement or the reimbursement, must be included, with the shipment. We cannot accept international returns without this correct documentation.

IX. Guarantee

1. All the articles are according to the guarantee of the manufaturers, the guarantee is covered by the manufacturers and NON by Equi-Phoenix sl, as we are only intermidiary. (generally 12 months up to 24 months.). All good sold they are satisfied to the present legislation and they remember the consumers who these articles and conditions do not affect the statutory rights to him.

X. Marks

1. The marks and logo’s that appear in the catalogue or page Web are marks of Equi-Phoenix s.l. and of third, as registered or not registered, and any type of announcements or other advertising materials cannot be used in, relative to the distribution of any information or content extracted of the catalogue or Web-page without the previous consent by writing of the owner of the label.  

XI. Others

1. The present general conditions of sale, as well as the signed contracts, are governed by the applicable legislation.

2. Any litigation relative to the interpretation or the execution of the general conditions of sale and all contract signed with a Client will be the exclusive competition of the Courts of Palma de Mallorca or the Courts.

 

XII. Policy of privacy

Your security and isolation are our priority; it is not our policy to pass your email address or details to other retailers. The information that you provide are only to allow us to process your order and to provide a high level of the service of attention to the client. Making purchases with us allows you to receive communications of Equi-Phoenix s.l. by fax, electronically or by mail.
